1. Agreement to Terms

By accessing or using Palate ("the Service"), operated by Studio Heights ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Palate is an AI-powered social media content management platform designed for restaurants and food businesses. The Service allows users to upload photos, generate Instagram captions and hashtags using artificial intelligence, schedule content, and manage client approvals.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. User Content

You retain ownership of all content you upload to the Service, including photos, captions, brand information, and menu data ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service.

You represent that you have the right to upload and use all User Content, including any photos, trademarks, or intellectual property. You are solely responsible for your User Content and any consequences of sharing it.

5. AI-Generated Content

The Service uses artificial intelligence to generate captions, hashtags, and content suggestions. AI-generated content is provided as suggestions only. You are responsible for reviewing, editing, and approving all content before publishing it to any platform.

We do not guarantee the accuracy, appropriateness, or originality of AI-generated content. You assume full responsibility for any content you choose to publish.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on third-party intellectual property rights
• Attempt to access other users' accounts or data
• Use the Service to generate harmful, misleading, or deceptive content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated systems to access the Service beyond normal usage patterns

7. Third-Party Services

The Service integrates with third-party services including Google Drive and Instagram. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or functionality of third-party services.

8. Payment and Subscriptions

Certain features of the Service require a paid subscription. Pricing, billing cycles, and payment terms will be presented to you before purchase. Subscriptions automatically renew unless cancelled before the end of the current billing period. Refunds are handled on a case-by-case basis.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through the account settings. Upon termination, your data will be permanently deleted within 30 days.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Studio Heights shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
